`z In consideration of the cash down payment made on the closing of the
sale of the above described propert~, upon request of the m~rtgagor,the
- Yy mortgagee covenants and agrees by the acceptance of this mortgage to
~ = ~ release 6.195 acres of the above described property as se~ected by the
; mortgagor without payment of any further consideration therefor. The
mortgagee further covenants and agrees to release additional lands from ~
; the lien of this mortgage from time to time in increments of not less
€ than three (3) acres each as selected b the mort agor at and for a ~
i " release price of Five Thousand Dollars ~($5,000.00~ for each acre re-
~ leased. If any of the lands upon which a release from the mortgage has
~ - been requested have been subdivided and platted of record, then platted
~ lots shall be released upon payment of a release price for each lot
~ equal to the foregoing per acre release price divided by the yield in
s platted lots per acre as shown by the subdivision plat. After the firs
K release, all lands released from the lien of this mortgage shall be
" contiguous to lands previously released from this mortgage. The accu-
~ mulated total of acreage released from this mortgage shall at no time
L- contain more than 10$ within 200 feet of 33rd Street. The mortgagee
~ shall not be required to give any release while a default exists on
~ this mortgage or the note secured hereby. Al1 principal payments on
~ the note secured by this mortgage whether such payment is an annual
principal payment or a prepayment of principal shall entitle the
~ mortg~gor to releases in accordance with the foregoing provisions and
~ all sums paid for releases of property shall be applied to the next
~ principal payment or payments due on the note secured by this mortgage.
The mortgagee will~ upon request, consent to and join in the execution
F` of recordable subdivision plats of the property and any drainaye~ or uti
lity easements required for development of the property and subdivision
building and use restrictions on the property, and will consent to and
cooperate with the mortgagor in obtaining such re-zoning and/or annexa-
tion to the City of any portions of the property as may be desired by
