J. Brantley Schirard, who being first duly sworn, did depose

1. That he has personal knowledge of the facts stated
herein.
2. That he was acquainted with James H. Brooks who con-
veyed certain property to J. Max O'Neill on about November 1,
1963 and was familiar with the property conveyed.
3. At the time of said cor.veyance James H. Brooks was
married to Polly Brooks who is now deceased and the said James
H. Brooks survived her and is living as of the date hereof,
