Mortgagor frnm all or any part of the Premises, ~fortgagor agrees to ~
pay the fair And reasonable rental ~alue for the use aud occupaucy
of the Premises or anp portion thereof which are in its possession for •
snch period and, upon default of any such payment, will vacate and
surrender possession of the Premise~ to the ~ortgAgee or to a receiver,
if auy, aud in default t}~ereof may be evicted by any summar3• action
or proceeding for the recovery or possession of premises for non-
payment of rent, however designated.

S~ox 3.01. In the event any one or more of the provisions ~
contained in this Ddortgage or in the Note or in the Bnilding Loan
Agreement shall for any reason be held to be invalid, illegal or nn-
enforceable in any respect, snch invalidity, illegality or unenforce-
~ ability shall, at the option of the biortgagee, not affect any other
provision of this liortgage, but this Diortgage shall be construed as
: if such invalid, illegal or unenforceable provision had never been
~ contained herein or therein.

° SECTSOx 3.02. ~11 notices herennder shall be in writing and shall
{ be deemed to have been su~ciently given or served for all pnrposes
~ wben presented personally or sent by registered mail to any party
~ hereto at its address above stated or at snch other addresa of which
r it shall have notified the party giving such notice in writing.

~ SECrio~ 3.03. Whenever in this Mortgage the giving of notice by
~ mail or otherwise is required, the giving of such notice may be waived
- in tivriting by the person or persons entitled to receive anch notice.

conditions herein shall run with the land and shall apply ta, bind and ~
inure to the benefit of, the successors and assigns of the Mortgagor and • ;
the successors and assigns of the Mortgagee.
