RIGHT-OF-WAY EASF:MENT
THIS INDENTURE, Made this the _~day of `~~L~,r ,
A. D., 1972, between ROBERT F. McROBERTS, JR., Trustee, party of the
first part, and CITY OF FORT PIERCE, a municipal corporation of the
State of Florida, party of the second part,

WITNESSETH: That the said party of the first part, for and in =

consideration of ) and other valuable
considerations to him in hand paid by the party of the second part, ?

the receipt whereof is hereby acknowledged, has granted, bargained ~

and sold, and by these presents does grant, bargain and sell to the ~
said party of the second part, its successors and assigns, a perpetual ~
easement and right-of-way over, upon and across the following des-
cribed land, lying and being in St. Lucie County, Florida, to-wit:
An easement 10 ft. wide Easterly-Westerly and 300 ft. long S
Northerly-Southerly lying immediately West of and adjacent
to the West Right-of-Way line of State Road A-1-A in Section
5-Township 36 South-Range 41 East, St. Lucie County, Florida;
said easements 300 ft. dimension being centered on a line
extended West of and perpendicular to the center of the
existing bridge at Little Mud Creek and its intersection
with the West Right-of-Way line of said State Road A-1-A. ~

This deed is made for the purpose of giving and granting to the
party of the second part, its successors, legal representatives and
~ assigns, a right-of-way and perpetual easement in and to said lands

~ for water main purposes; and the said party of the first part does

s hereby fully warrant the title to said lands, and will defend the

~ same against the lawful claims of all persons whomsoever, claiming

~ by, through or under party of the first part.

~ TO HAVE AND TO HOLD the same unto the second party, its successors
~ and assigns, together with immunity unto the second party, its successors

~ and assigns, from all claims for damage, if any, arising from or ~

~ growing out of such construction and/or maintenance, to the lands, ~
