PUBLIC UTILIIY EASEMENT
BY THIS INSTRUMENT dated this lOth day of ~anuar~: , 19%~ ,
FORT PIERCE FIELDS PLAZA, a Joint Venture composed of MELVIN F. SEMBLER,
married, FRED A. BESHARA, not married, ALBERT L. DANGLER, married, and
NICHOLAS MANOS, married, the Graators, for the consideration of TEN DOLLARS
($10.00) and other valuable consideration received to their full satisfaction
of the CITY OF FORT PIERCE, a municipal corporation of the State of Florida,
~ the Grantee, do hereby grant, convey, release and relinquish unto the said
Grantee, a non-exclusive EASII~IENT for the purpose of: ~
Constructing, layi~g maintaining, repairing and operating:
water pipes for transporting water; gas pipes for transporting
gas; and electric power lines and poles for transporting
electric power,
at Grantee's expense upon, over and under the C.rantors~ premises, located in
the City of Fort Pierce, County of St. Lucie and State of Florida and more
particularly described in Exhibit "A" attached hereto and incorporated herein.
PROVIDED, however:
1. The Easement granted hereby is intended to be and shall be for the sole
purpose of furnishing the above mentioned public utilities to the lands
of the Grantors', their heirs, assigns and grantees, as described in:

~ 2. The Easement granted hereby shall not conflict with easements heretofore
~ granted by Grantors.

~ 3. Grantors reserve the right to grant other easements or rights-of-way over
~ the same area to other grantees, provided such other grants will not
# unduly interfere with the purposes of the Easement as hereinbefore set
forth.

~ 4. Said utility pipes, wires and poles are to be constructed, laid,maintained,
~ repaired and operated by the Grantee in strict accordance with all per-
~
} tinent laws, rules and regulations of all applicable governmental agencies.

S. Grantee will immediately repair any damage occuring to Grantors' property
~ and any improvements thereon resulting directly or indirectly from the
said construction, laying, maintaining, repairing and operating of the
~ said utility pipes, wires and poles.

x 6. Said utility pipes, wires and poles will be at all times so placed, con-
structed, laid, maintained, repaired and operated as not to interfere with
any improvements nar or hereafter placed upon Grantors'' premises.
AND FOR VALUABLE CONSIDERATION paid BETTY S. SEMBLER, wife of MELVIN F. SEMB~,
= CHARLOTTE DANGLER, wife of ALBERT L. DANGLSR, and DOROTHY A. MANOS, wife of
~ NICHOLAS MANOS, hereby release all rights of DOWER in the above described
= EAS EMENT .
