I! Nots,~ithstanding the provision of paragraph 5 of this lease, it is understood
' that the Lessors will receive a delay rental in the sum of $10,~37.50 each U
` year during the term of this lease, that the lease is kept in force by a 1~
I paytnent of rental, it be~g ur~derstood that lessors own one-half of the ~r~
; undivided interest only to the oil and gas rights on the hereinabove described `1-
~ property. Lessee agrees that it will pay the delay rentals each year of the
~ term of tl:is lease unless it flirnishes ten days ~rit;~,en notice of cancellation
i of the lease prior to each anniversary date, or until such time as Lessee
~ pays oil royalties as provided in paragragh 3 and paragraph 10.

its servants, agents or employess by reason of e~loration or other use of the

~ There ia eacepted and eucluded from this lease and reserved and retained to Lessor, all sedimen-

~ tary minerals including sand, clay, limestone, dolomitic limestone, chert~ flint, marl and phosphate,
above 150 ft in depth, and Lesaor reserves the right of mining~ proceseing, and transporting or mar-
- keting theae sedimentary minerala eacepted fmm this lease. Oil~ gas, sulphur and salt, wherever
situated, are not excepted or excluded from this lease~ and no minerala situated at a depth in e$cesa
~ of 150 ft. from the surface of the land covered by this lease are eacepted therefrom.
In the event of damages to the surface of Lessor'a land, or to Lessar's grovea, trees, fence~,
roads or growing crops and inatallatione proaimately caused by Lesaee as a result of Lesaee's opera-
- tiona on the land covered by thie leaae, I.essee at its option will either pay Lessor for auch damages,
or will, insofar as ie rea~onably practicable, restore the property to the eame condition as it wae be-
~ f ore operatione were begun.
The I.eseee agrees that, upon the lawful termination of the lease-it will~ upon written request~ eae-
~
~ cute and cause to be recorded in the Public Recorde of St Iucie County~
