(a) Mortgsgee is authorized at any time, without notice, in its sole dittretion to enter upon a~d take poucssion of the
p~einises or any part thercot. to pertorm any acb Mortgagee deems neceuary or pmpe~ to conserve the security and to coliect
and reccive all rents, issua and profib thereof, inetuding those paat due as we11 as those accruing therealter, and
(b) Mortgagee shall be entitled, as a matte~ of strict rig6t and without regard to the value or occupancy of the security,
to ha~•e a recei~•er appointed to enter upon and ta1~e posseuion of the premises, collect the nnts and protib therefrom and apply
the same as the court may direct, such recriver to ha~•e all the rights and powen permitted under the laws ot Florida.
In either such case 1ltortgagee o~ the receiver may alto take poss~ssion o(, and for these purposes use, any and all personal
property contained in the premises and used by Mortgagor in the rental or leasiy~ thereo( or any part thercof. The expc~se
(including receiver s(ea, counsel fers, costs and agent's compensation) incur~e~.~unuaot to the powen herein containn~ shall
tx secured hereby. 1liortgagee shaQ (after paymrnt of all cosb and expenses incutred) apply such re~u, issues and profits recei~•ed
by it on the indcbtedn~st secured hereby in such order as I~lortgagee d~termines. The right to c~ter and take possc~ssion of said
property. to manage and operate the same, and to collect the renb, iuues and profits thereof, whether by a recei~•er or otherwisr,
shaU be cumulative to any other right or remedr hereunder or afforded by law, and may be erercised concurrently therewith
or independently thereof. Mortgagee shall be Gable to account only [or such renu, issues and protiu actually received by 1liortgagee.
14. If the indebtedneu secured hereby is now or hereafter further secured by chattd mortgages, pledges, contracts of
guaranty, assignments of leases, or other securities, or if the premisa hereby encumbered consisu of more than one parcel,
1liortgagce may at iu option erhaust any one or more of said securitia and the security hereunder, or such parcels of the security
hereunder, either concurrently or irtdepe~dently, and in such order as it may determine.
I5. No delay by Mortgagee in exercisi~g any right or remedy hereunder, or otherwise a(forded by law•, shaU operate as a
waiver thereof or preclude the exerciu thereof during the continuance a( any detault hereunder. :Vo wai~•er by Mortgagee of any
default shall constitute a waiver of or consent to subsequent detaults.
16. ~Vithout a(fecting the liability of any penon( other than any person reteased punuant hereto) for payment of any
indebtednest securtd hereby, and without a[fecting the priority or extent of the lien herco( upon any property not specifically
released punuant hereto, Mortgagee may at any time and from time to time, with~ut notice and without limitation as to any
legal right or privilege of Mortgagee:
(a) Release any person liable for payment of any indebtcdness secured hereby.
(b) Eatend the time or agree to alter the ternu oE payment of auy of the indebtedneu.
(c) Accept additional security of any kind.
(d) Release aay prop~rty securing the indebtedn~ss_
(e) Consent to the cr~ation of any easement on or over the premises or any covenants ratricting use or occupancy thereof.
17. Any agreement hereatter made by Mortgagor and ~iortgaget pursuant to this mortgage shall be superior to the righis
of the holder o( any inten-ening lien or cncumbrance.
18. Iliortgagor hereby wai~a all right of homestead exemption in the property subject to this mortgage.
19. The co~~enanu and agreements herein contained shall biad and the bene(its and advantages shaU inun to the respecti~~e
heirs, eaecutors, administrators, succuson and assigns of the partia hereto. Wherever used, the singular number shall include
the plural, the plural the singular, and the use of any gender shaU be applicablt to aU genden. A11 covenants, agreemenu and
undertakings shall be joint and sev~cal. In the evcnt additional numbered covenants are [or convenience inserted in thu mortgage
foliowing the legal dacription, such additional covenants shaU be read and gieen eftect as though following this covenant in
consecu4ve order.
20. Any deficiency in the amount of such aggregate monthly payment shall, unless made good by the 1?iortgagor prior to
the due date of the next such payment, constitute an event o! default under this mortgage. At Mortgagee's option, Mortgagor will
pay a"late charge" not exceeding (our per centum (4%) of any installment when paid more than Gfteen (15) days after the
due date thereof to cover t??e extra ~xpense involved in handling delinquent pa~Tnents, but such "late charge" shall not be payable
out of the proceeds ot any sale made to satisfy the indebtedness secured hereby, unless such proceeds arc suf(icient to disc6arge the
entirc indebtednas.
