MORTGAGE AND NOTE MODIFICATION AGREEMENT
THIS MORTGAGE AND NOTE MODIFICATION AGREE1~iENT, made and entered
into this day of /~?~tI1 ,1972, by and between W. S. DU BOSE,
INC., a Texas corporation, hereinafter referred to as "Mortgagor" and
THE FORT WORTH NATIONAL BANK, a national banking association organized
an~d existing un8er the ~,aws of the United States of America, herein-
after referred to as "Mortgagee".
W I T N E S S E T H;
WHEREAS, the said Mortqagor, did execute and deliver to the said
~#artgagee,.a certain gromissory nate ur~der date of Segtember 14, 1971, -
in the original principal amount of One Hundred Sixty-two thousand
dollars ($162,000.00), bearing interest at the rate of eight and one-
half percent (8~C$) per annum and said Mortgagor did further execute
a Mortgage under date of September 14, 1971 to secu~re said note, said
Mortgage being recorded in Official Records Book 195, Page 2051,
Public Records of Saint Lucie County, Florida, whicYi Mortgage encumbers
certain real property lyinq and being in Saint Lucie County, Florida,
and described therein: ~
WHEREAS, the parties hereto have agreed to modify the terms and
conditions of said note and Mortgage in order to change the date
upon which the entire unpaid balance of principal and interest accrued
shall be due and payable;
NOW, THEREFORE, in consideration of the premises and mutual
covenants herein set forth, and for Ten Dollars ($10.00) and other
valuable considerations, the receipt of which is hereby acknowledged,
it is hereby agreed and ~ovenanted by and between the parties hereto
that the terms of the aforesaid note and Mortgage shall be and are ;
hereby modified as follows:
