per plat thereof recorded in Plat Book 10, paqe 8 of the
public records of St. Lucie County, Florida
Personally appeared beEore me John W. Collins, who first
being duly sworn did say:
1. That he is Vice President and Loan Officer for First
Federal Savings and Loan Association of Fort Pierce, and that as
such he has personal knowledqe of the facts herein alleged and is
authorized to make this affidavit.
2. That in conjunction with a construction loan given by
First Federal Savings and Loan Associatian of Fort Pierce to
N~ Marvin H. Smith and Roberta T. Smith, secured by a mortgage on
Lots 10 and 11, Block 7, SILVER LAKE PARK ADDITION, as per plat
thereof recorded in Plat Book 10, page 8 of the public recozds of
St. Lucie County, Florida, he caused to be prepared that certain
notice of commencement acknowledged on February 4, 1972, recorded
February 15, 1972, in O.R. Book 199, page 1998.
3. That said notice of commencement recorded in O.R. Book
199, page 1998, through scrivener's error, included Lots 22 and 23,
Block 7, Silver Lake Park Addition, which said Iots, though then
owned by Marvin H. Smith and Roberta T. Smith, his wife, were not
subject to the construction mortgage given by First Federal Savings
and Loan Association of Fort.Pierce, and were not subject to construc-
tion.
4. That concurrently herewith, an amended notice.of
commencement is being filed in the public records of St. Lucie
County in order to amend the notice of commencement recorded in
O.R. Book 199, page 1998, which erroneously included Lots 22 and 23,
Block 7, Silver Lake Park Addition.
