DECLARATION OF PARTY FACILITIES
BEACH CLUB COLONY
SECTION ONE
ST. LUCIE COUNTY, FLORIDA
THIS DECLARATION, made this 2~fh day of April ~ 1972,
by BEACH CLUB COLONY OF STUART, INC. , a Florida corporation~ here-
by states as follows;
1. That Declarant, BEACH CLUB COLONY OF STUART, INC. , a
~nrida corporation, is the owner in fee simple of certain lots in BEACH
CLUB COLONY, SECTION ONE, situate and being in the County of St. Lucie,
State of Florida, according to the plat thereof, filed May 13, 1971 and re-
corded in Plat Book 16~ page 11~ St, Lucie County, Florida, public records.
Declarant is constructing upon each of said lots two (2) single~family dwell-
ing structures connected by a common wall. Each such structure is designed
to be occupied solely by a single family living independently of all others, but

will share a common wall with the adjoining structure.
2. The cemmon ~all shared by the two (21 single~family dwelling
~

~ structures, will be located on an imaginary line dividing each of the afore-
~ said lots into two (21 separate, distinct and approximately equal parcels~ as
more particularly described in Exhibit "A", which is attached hereto and
made a part hereof, and shall be a party wall for the perpetual benefit of
and use by the purchaser, including the heirs~ assigns, successors and
grantees, of each such single-family dwelling structure.
3. In the event that it shall become necessary or desireable to per-
form maintenance upon, to repair or to rebuild the whole or any part of the
~ arty wall, such expense shall be shared equally by the purchasers of ad-

joining units or by their successors in title. Whenever any such wall, or
any part thereof shall be erected in the same manner at the same location
at which it was initially constructed, and shall be of the same size and of
