FOR VALUE RECEIVED, the undersigned, jointly and severally, PROMISE
TO PAY to the order of FRANK SHUGERT and FLOSS r1. SHUGERT, his wife;
LUCILE H. SriITH; JOHN A. BECK, JR, and FRANCES W. BECK, his wife,
and WALTER N. PLAUT and SALLY H. PLAUT, his wife, TWENTY-SIX THOUSAND
and no/100 ($26,000.00) DOLLAFcS, at such place as the holders hereof
may designate in c,rriting, to ether with interest from date at the
rate of~seven per centum (7%~ per annum on the unpaid balance until
• maturity. The said principal and interest shall be due and payable
in five (S) equal annual installments plus interest on the balance
remaining from time to time unpaid, the f irst installment being due
18 Mav_ 1973 , and the final installment due on the
18th day of ~y , 1977.
The Makers have executed and delivered this Note in a fiduciary
capacity. No money judgment shall ever be obtained against the Makers
of this Note. The Payee or Halder hereof shall look solely to his
Mortgage security in payment of this Note. This note may be prepaid
in whole or in part at any time prior to maturity without penalty.
If default be made for 30 days in the payment of any install-
~ ment of principal or interest or any part thereof, the whole sum then
' remaining unpaid ~,iith interest shall at holder's option become due and
! payable without notice. Failure to exercise such option shall not
' constiture a waiver oi the right to exercise the same in the event of
subsequent default. After maturity both principal and accrued interest
shall bear interest at 7 per centum per annum until paid. The makers
and endorsers of this note further waive demand, notice or non-payment
and protest. If this note is not paid at maturity and the same is
placed ~rith an attorney for coZlection, the makers and endorsers hereof
agree to pay all cosis of collection, including all court costs and
reasonable a~torney tees.
