MObIFICATION OF MORTGAGE ~
WHSRSAS, FORT PIERCE HEIGHTS DEVSLOPMBNT CORP., a Florida
corporation, made and delivered its Mortgage to LEO WI~, which
l~rtgaqe wae dated December 4, 1965 and filed Decamber 15, 1965
in Official Recorde Book 133 at Paqe 240 of the Public Recorda
of St. Lucie County, Florida, and which Mortqage w~?s extended
by Extenaion Aqreement between the parties dated October 29, 1970, .
a co py of which Sxteneion Agreement ia annexed hereto, and which
Moxtgaqe encumbered Parcels 1, 2 A. an~d 2 B. shown on Schedule
A annexed hereto and made part hereof, and
WHERSAS Martqagor has requested of the Mortgagee that Mortga-
gee release the lands shown on Schedule A annexed•hereto and in its
place eubstitute the followinq land to be encumbered by the said
Mortqage, naa~ely the land described as Parcel 3 an the-Schedule_ _
annexed hereto, made part hereof and designated as Schedule B, and
WHEREAS, Mortgaqee is willing so to do.
NOW, THSREFORE, for good and valuable consideration, it is ~
agreed as follows:
1. That there is presently due and owing on the Note secured
by this Mortgage the swa of $36,000.00 with interest thereon from
March 10, 1972.
2. That the lands descri.bed on Schedule A are hereby released
from the encucabrance of the aforedeacribed Mortgage and Extension _
Agreement and in place and stead thereof there is substituted and
encumbered by the aaid Mortgage,~ as extended, the lands described
on Schedule B annexed hereto.
3. The said Mortgag~ does hereby warrant the title to the
landa described on Schedule B attached hereto to be free and clear
of any and all liens and encumbrances save and except for the taxes
of the year 1972.
4. In all other respects the said Note and Mortgage remain
~ in full force and effect. -
