This cause came on to be heard on the Plaintiff's
Motion for Summary Judgment, and there being present counsel
for the plaintiff and no one present for the defendant although
notice of the hearing was sent to Ned T. Smith, President of
, the defendant corporation, and it appearing tha-t the pleadings
and affidavits filed herein show that there is no genuine
issue of any material fact, and plaintiff is entitled to
judgment as a matter of law, it is thereupon, upon consideration
ORDERED AND ADJUDGED that the Plaintiff's Motion for
Summary Judgment be and the same is hereby granted ~nd judgment
is hereby entered in favor of the plain~i~f, I~ENE CORPORATION,
; and against the defendant, MODCO, INC., in the amount of Ten
