LESS AND EXCEPTING from Parcels One A and One 8 above, all
Iands and easements owned of record by or in the acutal
use and possession of any public or quasi public body,,
governmental agency, railway company, or utility company
for use as public roa6s, drainage canals and facilities,
railroads, power lines, telephone~linea or other like
uses.
It is the purpose of this conveyance to convey to tine Grantee all
of its right, title and interest in lands oE which it is~seized
and posse~sed in Government Lot 2, Section 34,Township 34 South,
Range 40 East and Government Lot 1, Section 3, Township 35 South,
Range 40 East and certain subn?erged lands adjacent to and immediately
East thereof as evidenced by that certain warranty deed from'Ft.
Pierce Financing and Construction Company to DiGiorgio Fruit Cor-
poration dated~June 15, 1946, filed June 20, 1946, in Deed Book
126 at page ll; ~hat certsin Warranty ~eed ~rom F. H. Conrad and
Dora Elizabeth Conrad, his wife, to DiGiorgio Fruit Corporation
dated ~une 22, 1946, filed July 15, 1946, in Deed Book 126 at
page 336; that certain warranty deed from Stacy H. Erts and
Vivian Erts, his wife, to DiGiorgio Fruit Corporation, dated
May 22, 1964, filed ~Iay 25, 1964 in Official Record Book 89
at Page 544; that certain quit-claim deed from Ft. Pierce
Financing and Construction Ca~npany to DiGiorgio Fruit Corporation
dated June 25, 1946, ~iled June 20, 1946 in Deed Book 126 at
page 9; that certa~n deed from the Trustees of ttie Internal Im-
provement Fund of the State of Florida to DiGiorgio Fruit Cor-
poration dated April 9, 1947, filed April 23, 1947 in Deed Book
134 at page 130, all references being to the public recorda of
St. LuGie County, Florida,
LESS A~1D EXCEPTING THEREFRO~i the exceptions as heretofore stated.
NOTWITIiSTANDING anything appearinq to the contrary, it is speci-
fically understood that as to all submerged or filled land the
Grantor covenants and warrants only that said lands are free from
all encumbrances made by the Grantor and that this deed is made
subject to any and all rights of the United States Government and
the State of Florida arising by reason of United States Government
control over the navigab2e waters in the interest of navigation
and commerce and the inalienable rights of the State of Florida
in lands and/or.waters of such character.
