HomeMy WebLinkAbout2467 ~ ~ ~G~VI~`~V~ QUIT-CLAIM DEED THIS QUIT-CLAIM DEED, executed this ~ day of ~une, A.D. 1972 by M. A. RAMSEY, L. W. HALBE and FRANK FEE as and constituting the Board of Trustees for the property owned by Fort Pierce Properties, Inc., a dissolved Florida corporation, formerly having its principal place of business at Fort Pierce, Florida, as parties of the first part, to HENRY MIESZ and FRIEDA MIESZ, his wife, whose post office address is 6096 Lander Haven Drive - Mayfield Heights, Ohio 44124, second parties; WHEREAS, Fort Pierce Financing and Construction Company was originally incorporated under the laws of the State of Florida and ' . thereafter did, by amendment to its corporate charter, cause its corporate name to be changed to Fort Pierce Properties, Inc.; and ~ WHEREAS, Fort Pierce Properties, Inc.~was subsequently dissolved pursuant to law with the last Board of Directors thereof consisting of the named parties of the first part and the late Arthur E. Roberts and the late O. G. Nanney; and WHEREAS, the hereinafter described real property was by deeds dated April 2, 1925, March 6, 1928 and April 23, 1928 conveyed to one Edwin Binney, which deeds were respectively recorded in Deed Book 63 at page 56, Deed Book 78, page 504, and Deed Book 79, page 57 of the public records of St. Lucie County, Florida, all of which conveyances were upon conditions, restrictions, and limitations therein more particularly set forth, the violation of which was to cause th~ title °~r conveyed to immediately revert to the named grantor, its successors ' ~'~y and assigns; and WHEREAS, by deeds dated February l, 1951 and recorded in Deed ~ Book 175 at pages 219, 223 and 225, respectively, the then Trustees under the Will of Edwin Binney, deceased, deeded the hereinafter described land to Binney Properties, Inc.; and which last named corporation by warranty deed dated April 4, 1956, recorded in Deed Book 213 at page 513, warranted and conveyed said land to parties~of the second part; and WHEREAS, the recorded Plats fail to reflect the distances for the side lot lines, the water frontage, or the required angles and ~ it being the desire of grantors to vest good and merchantable title ; to said land in grantees free and clear of the hereinbefore mentioned ~ conditions, restrictions and limitations and the penalty for violation ~ thereof, all of which have long since become outmoded and were abandoned ~ by Fort Pierce Financing and Construction Company when it conveyed ~ numerous lots in Fort Pierce Beach Subdivision to Fort Pierce Beach Development Company; NOW, THEREFORE, THIS INDENTURE WITNESSETH: That the said first parties, for and in consideration of the sum of $10.00 in hand paid by the said second parties, the receipt whereof is hereby acknowledged, does hereby remise, release and quit- claim unto the said second parties forever, all the right, title, interest, claim and demand which the said first parties have in and to . ~ the following described 1ot,_piece or parcel of land, situtate, lying ~ and being in the County of St. Lucie, State of Florida, to wit: ~ Lots 5, 6 and 7, Block 16 of the Revised Map of Fort Pierce Beach, as recorded in Plat Book 8, page 29, of the public records of St. Lucie County, Florida, being Q more particularly described as follows: ~ r S~IAT~t°p~_s~~P~.
