- 3. The Party of the Second Part does hereby prant unto
the Par~ies of the First Part, and their successors and assigns,
a non-exclusive permanent easer~ent for the purpose of taking
water from and of discharging waters into that certain Sump Lake
located upon the proper~y of the Party of the Second Part north
of the Sunshine State Parkway in the northeast corner of Section .
25 and/or southeast corner of Section 24 (near the northwest
corner of Block 4 as shown on the aforemzntioned plat). The Party
of the Second Part does further grant unto the Parties of the Firs
Part the right to take waters from the canal of the Party of the
Second Part lying south o: the Sunshine State Parkway immediately
ad~acent to the double box culvert under said Parkway on the east

side of Section 25 and/or Section 24, Township 3~ South, RanGe 37
East, St. Lucie County, Florida, for irrigation purposes and, in ~
this connection, to install and operate a pump in and at said
canal to facilitate the transfer +~f water from said.canal via the
Sump Lake to the property of the Parties of the First Part.
4, The Party of the Second Part reserves the ri~;ht at
any and all times to take water from said Sump Lake and canal ~

and to discharge water into ~he same, and at all times to have
the free and uni.nterrupted use of said Sump Lake and canal for
all general purposes connected with the use of i~s property but
shall not at any time do any act that will prevent the free use ~

of said facilities by the Parties of ~he First Part witriout ~
furnishing equ3valent irrigation and drainage facilities. ~

5. The parties hereto shall have ~oint use of that '

certain twin-box culvert ar_d Swr.p Lake located on the property t
of the Party of the Second Part north of the Sunshine State
Parkway in the northeast corner of Section 25 and/or southeast
corner of Section 24 (near northwest corner of Block 4 as shown on i

said pZat), provided that the said twin-box culvert which belon~s ~
to the Florida Department of Transportation shall at all tf.mes
be sub~ect to its re~;ulation and controi.
