RE: Beginning at a point on the West right-of-way of U.S.
Highway No. 1, 800 feet North of the South line of the
SE 1/4 of NW 1/4 of Section 17, Tawnship 34 South, Range
40 East, as measured along the perpendicular, thence turn
and run West, parallel with the South line of the South-
east 1/4 of the Northwest lj4 of said Section, 300 feet
to a point; thence turn and run ~South parallel with the ~
West line of the Southeast 1/4 of the Northwest 1/4 of
said Section, 300 feet to a point; thence turn and run
East parallel with said South line, 436.85 feet to the
West right-of-way line of U.S. Highway No. 1; thence
turn and run Northwesterly along said West right-of-way
line of U.S. Highway No. 1, 329.6~feet to the point of
beginning.

BEFORE ME, the undersigned authority, personally appeared
CHARLES E. BECHT, who, after being first duly sworn, deposed and said:
1. That he is a practicing attorney at law in Fort Pierce,

St. Lucie County, Florida, and has acted as attorney for Arthur H. '

Abair in an attorney-client relationship from the time of his client's ~
original acquisition of the above-described property.
2. That the mortgage held by Arthur H. Abair from Salvatore -
Fragale and wife, recorded in O.R. Book 137, page 544, which mortgage
was the subject of foreclosure action in St. Lucie County Circuit
Court, Case No. 8497-E, was handled by the undersigned.
3. That the undersigned knows of his owr. personal knowledge
as attorney of record, that the quitclaim deed from Salvatore Fragale
and Helen Fragale, his wife, dated June 15, 1965, recorded in O.R.
Book 135, page 478, unto Arthur H. Abair, coverinq subject property,
covering subject property, was intended to cancel and fully release

the force and effect of that certain mortgage held by Arthu~~H. Abair,
recorded in Mortgage Book 137, page 5114, St. Lucie County, Florida,
pub~.ic re.cords; and further Affiant sayeth not.
