hereinafter called the Mortgagor, which tera~ a8 used in every instance shall include the
Nortgagor's heirs, executors, administrators, successors, legal representativea and
assigns either voluntary by act of the parties, or involuntary by operatian of law, and
shall denote the single and/or plural, and the mascu2lne and/or feminine, an~ natural
and/or artificia2 persons, whenever and vherever the co~~Lext so requires or admits, party
of the first part, to SOUTHERN MORTGAGE ASSOCIATES,a corporation organized and exist-
ing under the laws of the State of Arkansa~?ereinaf ter called SMA, which term as used
in every instance shall include SMA 's successors, legal representatives and assigns, party
of the second part.
WITNESSEIH: That for divers good and valuable consideration , and also in consid-
eration of the aggregate sum of money named in the promissory note of even date herewith,
hereinafter described~ the Mortgagor does grant, bargain, sell, alien, remise, release,
convey atd confitm unto SMA, in fee simple, the following described property, of ~ttich
the Mortgagor is now seized and possessed and in actual possession, situste in the

TOGETHER with all structures and improvements now and hereafter on said land and the
fixtures attached there[o~ and all rents, issues, proceeds and profits accruing and to
accrue from said presnises, all of ~ahich are included within the foregoing description and
[he habendum hereof; also all gas, steari, electric, water and other heating, cooking,
refrigerating, lighting, plumbfng, ventilating, irrigating~ and power systems, machfnes,
appliances, fixtures and appurtenances, including air-conditioning, ducts, machinery arid
equipment, vhich are now or may h~reafter pertain to or be used with, in or on said
pre~nises. even though they be detached or detachable, and together with the abstract of
title thereto, and.,-if the above described property is nov or shall hereafter be used
for commercial.purposes, then the furniture and furnishings and any replacaaents thereof
which may be owned by the Mortgagor and which are now or may hereafter be located upon
the above described property.
TO HAVE AND T~0 HOLD the same, together with the tenenents, hereditaments and
appurtenances, unta SMA in fee simple.
AND the Mortgagor does hereby covenant with SMA thatnlortgagor is it~defeasibly
seized of said land in fee simple; that mortgagor has full power and laxful right to
convey said land in fee simple as aforesaid; that it shall be lawful for SMA at all
times peaceably and quietly to enter upon, hold, occupy and en3oy said land; that said
property is free from all encumbrances; that mortgagor will make such furfher assurances
to perfect the fee simple title to said property in SMA as may reasonably be required;
and tE~at they do hereby fully varrant the tit2e to said land and will defend the same
against the laafu2 clafms of a12 persons vhomsoever.
NO~T,THEREFORE. the condition of this mortgage is such tha[ if the ?iortgagor shall
vell and truly pay unto SMA the indebtedness evidenced by that certain gromisaory note
of even date herevith, made by the Mortgagor and payable to the order of SMA , in the ~
