(a) I~tortgagee ia autho~ised at any time, without notice, in it~ sole discretion to enter upon and take poucuion of the
p~emisa or any put the~eot, to pe~torm any acb Mortgagee deems ~eces~ary or proper to conserve the security and to collect
and receive all rents, issua and profits thereof, including those past due as well as those accruing thereatter. and
(b) Mortgagee shall be entitled, as a matter ot strict right and wiihout ~cgard to the a•alue or occupancy o( ~he security,
to have a rcceiver appointed to cnte~ upon and take posseuion ot the promises, collect the rents and p~oCts therefcom and apply
the same as the court may direct, such receiver to have all the righb and powe~s permitted under the laws of Florida.
In either such case Mortgagee or the ~ecciver may alto take posseuion of, and for these purposes use, any and all penonal
property contained in the premises and used by Mortgagor in the rental or lcasing thereo! or any part thereof. The e:pe~se
(including receivers tees, co~nul fees. costs and agent's compensation) incurred pursuant to the powers herein contained shall
Ix xcured hereby. 111ortgagee shall (after payment o[ all costs and expenses incurrccl) apply such rrnts, issua and profi~s received
by it on the indebt~dn~ss secured her~by in such order as Mortgagee determina. The right to enter and take pouession of said
property, to manage and operate the same, and to coUect the renb; iuues and pro~b thtteof, whether by a receiver or otherwise,
shaU be cumulative to any other right or remedy h~nunder or afforded by law, and may be exercised concurrently thercwith
or independently thereof. Mortgagce shall be Gable to account only for such rents, issues and pro[its actually recrived by Mortgagee.
14. If the indebtedness secured hereby is now or hereafter further secured by chattel mortgages, pledga, contracts of
guaranty, assignmenb of le~su, or other securities, or if the premises hereby encumbered coruists of more than oae parcel.
1lfortgagee may at its option rxhaust any one or mo~e of said securities and the security hereunder. or such parceh of the security
hereunder, either concurrcntly or independently, and i~ such order as it may determine.
IS. No delay by Mortgagce in exercising any right or mmedy hereunder. or otherwiu a[forded by law, shall operate as a
waiver thereof or preclude the exercise thereof du~ing the continuance of any default hereunder. No wai~•er by Mortgagee o[ any
detault shall constitute a waiver of or consent to subsequent defaults.
16. ~Yithout a[fecting the liability of any person( other than any penon rcteased punuant hereto) for payment of any
indebtednus secured hereby, and without af[ecting the priority ot eatent of the lien hereof upon any property not specitically
released pursuant hereto, Mortgagee may at any time and from time to time, without notice and without limitation as to any
legal right or pria•ilege oE Mortgagee:
(a) Release any person liable [or payment of any indebtedneu secured hereby.
(b) Extend the time or agree to alter the ternu of payment of any of the indebted~ess.
(c) Accept additional security o( any kind.
(d) Release any prop~rty securing the indebtednw.
(e) Consent to the creation of any easement on or over the pnmises or any covenants ratricting use or accupancy thereof.
17. Any agreement hereatter made by Mortgagor and Mortgagee pursuant to this mortgage shall be superior to the righu
of th~ holder of any internening lien or encumbrance.
18. I?iortgagor hereby waiva aU right of homatead exemption in the property subject to this mortgage.
19. The covrnants and agreemenb hercin contained shall bind and the benJts and advantages shall inure to the respective
heirs, executoa, adminutraton, succason and assigns of the parties hento. Whern~er used, the singular number shall include
the plural, the plural the singular, and the use o( any gender shall be applicable to all genden. All coveoants, agreements and
undertakings shaU be joint and several. In the evrnt addition~l numbered coveaanu are tor convenieece inserted in this mortgage
following the legal description, such additional covenants shall be read and gi~en ettect as though following this covenant in
consecutive order.
20. Any deficicncy in the amount of such aggregate_ mont6ly-payment shall. unless made good by the Mortgagor prior to
the due date of the next sucL payment, constitute an event of default under this mortgage. At Mortgagee's option, Mortgagor wiU
pay a"late charge" not exceeding four per centum (496) of any installment when paid more than filteen (15 days after the
