HENDERSON, his wife hereinafter called the Mortgagor, ahich term as used in every instance shall include the Mortgagor's heirs. executors. administrators, successors, legal representatives and assigns either voluntary by act of the parties, or involuntary by operation of law, ac~d shall denote the single and/or plural, and the masculine and/or feminine, a~d natural and/or artificial persons, whenever and wherever the cont t so requires or admits, party of the first part, to SOUTHERN MORTGAGE ASSOCIATES/,~~arporation organized and exist- ing under the laws of the State of Arkansas~ereinaf ter called SMA, which terin as used in every instance shall include SMA 's successors, legal representatives and assigns, party of the second part. . WITNESSETtt: That for divers good and valuable consideracion , and also in consid- eration of the aggregate sum of money named in the promissory note of even date herewith, hereinafter described~ the Mortgagor does grant, bargain, sell, alien, remise, release, convey and confirm unto SMA, in fee simple, the following described property, of which the Mortgagor is now seiZed and possessed and in actual possession, situate in the County of st. Lucie , SLate of florida, to wit: Lot 7, Block 18, SUNRISE ESTATES. according to the Plat thereof recorded in Plat Book 8, pa?ge 75 of the Public Records of St. Lucie County, Florida. TOGETdER vith all structures and improvements now and hereafter on said land and the fixtures attached thereto, and all rents, issues, proceeds and profits accruing and to accrue from said presnises, a21 of vt?ich are inc2uded within the foregoing description and the habendum hereof; also all gas., stear~, electric, water and other heating, cooking, refrigerating, lighting, pZumbing, ventilating, irrigating, and pover systees, machines, appliances, fixtures and appurtenances, including air-conditioning, ducts, machinery and equipment. which are now or may hereafter pertain to or be used vith, in or on said premises, even though they be detached or detachable, and together arith the abstract of title thereto, and, if the above described property fs now or shall hereafter be used for cormnercial purposes, [hen the furniture and furnishings and any replacements thereof which may be owcted by the Mortgagor and which are noW or may hereafter be located upon . the above described property. TO HAVE AND TO HOI.D the same, together with the tenements, hereditaments and appurtenances, unto SMA in fee simple. AND the Mortgagor does hereby covenant with SMA that~iortgagor is indefeasibly seized of said land in fee simple; that mortgagor has full power and laWful right to convey said land in fee simple as aforesaid; that it shall be lawful for SMA at all times peaceably and quietly to enter upon, hold, occupy and enjoy said land; that said property is free from all encumbrances; that mortgagor will make such further assurances to perf ect the fee simple title to said property in SMA as may reasonably be required; and that they do hereby fully varrant the title to said land and will defend the same against the lawful claims of all persons whomsoevet. NOW,TNEREFORE~ the condition of this mortgage is such that if the Mortgagor shall well and truly pay unto SMA the indebtedness evidenced by that certain promissory note of even date herewith~ made by the Mortgagor and payable to the order of SMA , in the prfncipal sum ofFOURTEEN THOUSAND EIGHT HUNDRED FIFTY AND NO/100--------~.1LIARS ~S 14,850.00 together With interest (while not in default) at the rate of 8 X, repayable in equal monthly installments of $ 109.00 , including interest, the first of such payments being payable on September 1, 1972 and shall perform, comply vith and abide by each and every the stipulations, agreanents, conditions, and covenants contained and set forth in this mortgage and in the promissory note secured hereby, then this mortgage and the estate hereby created shall cease and be null and void. AND the Mortgagor does hereby covenant and agree: 1. To perform, comply with and abide by each and every the stipulations, agree~nents, conditions, and covenants in this deed set forth, and in the above referred to prom~.ssory note. 2. To pay all and singular the principal and iaterest and other-suae of aoneq payable - by virtue of said promissorq aote and this mortgage, or either, prompt~.y on the daye respectively the saae severally cose due.
