HomeMy WebLinkAbout0118 the Mortgagor is indefeasibly seized of said land in fee simple; that the Mortgagor has good right and lawful authority to convey said land as aforesaid; that the Mortgagor hereby fully warrants the title to said land~and will defend the same against the law- ful claims of all persons whomsoever; and that said land is free and clear of all liens and encumbrances except as hereinafter described in Schedule "C" attached hereto. PROVIDED, ALWAYS, that if said Mortgagor shall pay unto said Mortgagee that certain purchasP money note of even date here- with, in the amount of Four Hundred Thousand Dollars ($400,000.00) ' and shall perform, comply with and abide by each and every one of ! ; the agreements, stipulations, conditions and covenants thereof and E e of this mortgage, then this mortgage and the estate hereby created shall cease, determine and be null and void.
