ARTICLES OF AGREEMENT, made this 15th day of September A.D.1972
between Hazel J. Harris, an unremarried widow,
party of the first part and Herbert F. Preston and Doris M, Preston,
his wife, parties of the second part, 3?28 St. Marks Road, Fort Pierce,
FLorida.
WITNESSETH that if the said parties of the second part sha11 first
make the payments and perform the covenants hereinafter mentioned on
their part to be made and performed, the said party of the first part,
hereby covenants and agrees ~o convey and assures to the said parties
of the second part, their heirs, executors, administrators or assigns,
in fee simple, clear of all encumbrances v~hatever by a good and su£ficient
deed the following described property, ~o-wit:
The north 35 feet of Lot 3 and the south 45 feet of Lot ~1,
Block 9, St. James Park Subdivision as per plat thereof on
record in plat book 5, page 58, of the public records of St.
Lucie County, FLorida.
and said parties of the second part hereby covenant and agree to pay
to the party of the first part, her heirs and assigns at her office
in Fort Pierce, the sum of $17,000.00 in the following manner, to-wit:_
(1) $1,000.00 on the signing of th~s instrument, receipt of which is
hereby acknowledged.
(2) $138.00 per month interest and principal payment starting on the
15th day of October A.D. 19~2 and on the 15th day of each and every
subsequent month thereafter until the original installment balance
of $16,000.00 is paid in full. The aforesaid interest to be cal-
cula~ed on the unpaid balance due a~ the rate of 8.25~ per annum.
Each installment shall be first applied in payment of the interest
and then on the unpaid balance of the principal sum. A late pen-
alty of 5X will be added and collected with any amounts due and
payable under this contract which have not been paid by the 22nd
day of each month, this penalty sh311 apply to any past due ad
valorem taxes, special government assessments and fire insurance
which has been paid by the party of the first part to protect her
interest.
