WARRANTY DEED ~
TH[S WARRANTY DEED Made and executed the 30th day of August,
A. D. , 1972, by LEROY E. SMITH'S SONS, tNC. , a corporation existing under
the laws of Florida, and having its principal place of business at Veio Beach,
e., Florida, here~nafter called the grantor, to
~ GAYLE L, SMITH, ELSON R, SMITH & THOMAS F. O`HAIRE, III, as trustees
of the Profit Sharing Plan of L.EROY E, SMiTH'S SONS, INC, under Florida
Statutes, 1971, Chapter 689.071, with full power and authority to sell, convey,
grant, contract with, encumber by mortgage, or to manage and dispose of in
any way, whose post office address is North Federal Highway, Vero Beach,
Florida, hereinafter called the ~rantee: ~
WITNESSETH: That the grantor, for and in consideration of the sum
of $10.00 and other valuable considerations, receipt whereof is hereby acknowledged,
by these presents does grant, bargain, sell, alien, remise, release, convey and
confirm unto the grantee, all that certain land situate in [ndian River County ,
Florida, viz:
PARCEL 1: Tract 16, Section 14, Township 33 South, Range 38 East, according
to p at o Indian River Farms Company, recorded in Plat Book 2, page 25, public
records of St. Lucie County, Florida; now lying and being in Indian River County,
Florida;
PARCEL 2: All of Tract 13 and West 10 acres of Tract 14, Section 5, Township
. out , ange 39 East, according to plat of Indian River Farms Company,
recorded in Plat Book 2, page 25, public records of St. Lucie County, Florida;
now lying and being in In~iian River County, Florida;
PARCEL 3: The Northeast 1/4 of Southeast 1/4 of Section 8, Township 36 ~
ut , ange 39 East, St. Lucie County, Florida. EXCEPTING therefrom all
rights-of-way for drainage canals and public roads.
Subject to and grantees herein assume and agree to pay that certain mortgage
' to The Indian River Citrus Bank, a Florida corporation, dated May 31, 1972,
; recorded in Official Record Book 409, page 371, Indian River County records, ~

~ TOGETHER with all the tenements, hereditaments and appurtenances
~ thereto belonging or in anywise appertaining. ~

TO HAVE AND TO HOLD, the same in fee simple forever.
AND the grantor hereby covenants with said grantee that it is lawfully :
seized of said land in fee simple; that it has good right and lawful authority to '
sell and convey said land; that it hereby fully warrants the title to said land and
will defend the same against the lawful claims of all persons whomsoever; and
that said land is free of all encumbrances except taxes subsequent to 1971.
