In the event either the Lessor or the Lessee takes legal action to enforce or defend its rights under this lease as the result of a breach hereof by the other party, the prevailing party in such action shall be entitled to recover from the other party all Court costs and attorney's fees incurred in the action. 16. WAIVER. It is covenanted and agreed that no waiver of a breach of any of the covenants of this lease shall be construed to be a waiver of any succeeding breach of the same covenant. 17. TRANSFER OF LESSOR'S INTEREST. Lessor shall have the right to sell, mortgage or otherwise dispose of the underlying fee in the leased property subject, of course, to the terms and conditions of this lease and the rights of the Lessee hereunder. No sale of the fee shall terminate this ~ 't Lease or in any manner affect this lease or the rights of the Lessee hereunder, and the option to purchase the property granted to Lessee in tnis lease shall remain in fuli force and i ( ' effect following any sale by Lessor.
