BEFORE ME, the undersigned authority, this day personally
appeared, LAURA B. HANCOCK, who, upon first being duly sworn, did ~

depose and say, on November 16th, 1970, Thomas J. Payne and Bernice ~
C. Payne entered into a contract for the purchase of real property ;
with Herbert Heninger and Theresa Heninger, to wit;
Lot 2, Block 13, PARADISE PARK SUBDIVISION,
according to plat thereof, recorded in Plat
Book 8, Page 17 of the Public Records of
St. Lucie County, Florida.
1. Mr. and Mrs. Payne agreed to pay $750.00 to purchase
said lot. ,Mr. and Mrs. Payne paid $250.00 at the time of entering
into the contract, and paid 18 equal payments of $29.46 to the
Heningers.
2. Thomas J. Payne and Bernice C. Payne have paid aIl 18 ~

payments required under the contract and by and through their attorney ;
forwarded objections to a marketable title as was required by the ~
~
contract.
3. Herbert Heninger and Theresa Heninger have failed to
make any attempt to clear up the defect in saicl title.

4. While attempting to have Herbert Heninger and Theresa
~
Heninger deliver a marketable title, Mr. Herbert Heninger died. '
5. Under the terms of the contract Thomas J. Payne and
Bernice C. Payne have demanded that the title be cleared and made
marketable or the seller refund the $763.28 paid under the contract.
The seller has refused to comply with the terms and conditions~of
the contract.
