MEMORANDUM AGREEMENT ~~~!~2
THE UNDERSIGNED, Frank W. Fain and Annie M. Fain, his wife,
enter into the following Memorandum Agreement with B. E. McClanahan
as follows:
WHEREAS, Frank W. Fain and Annie M. Fain are purchasing the
following described property, to-wit:
The South one-half (S~) of the South one-half (S~)
of the Southeast Quarter (SE'~) of the Southwest
Quarter (SW~) of Section 8, Township 35 South, Range
39 East, ten (10) acres, more or less, LESS road and
canal rights-of-way of record. .
and
WHEREAS, the above parties desire to traverse the drainage
ditch which borders the above described property on the East
boundary by placing a drainage pipe 24 f t. x S tt. to be covered by
ingress right-of-way and
WHEREAS, the parties agree that this pipe shall be placed at
the dividing line of their properties one-half (1/2) on the North
boundary of Fain~s property and one-half E1/2) on the South boundary
of McClanahan*s property. .
NOW IT IS HEREBY AGREED that ~he parties shall share equa2ly
toward cost of all labor and materials necessary to incur the purchase
and to erect the pipe together with access easement thereon, and
THE PARTIES DO FURTHER AGREE to grant perpetual easement each
to the other, intending thak this right-of-way sha11 serve each
parties' property. '
IN WI SS WHEREDF, the parties set their hands and seals this
