Notk~ithst~nding the provision of paragraph 5 of this lease, it is understood
' that the Les~ors will receive a delay rental in the sum of $10,737.50 each
~ year c'uring the term of this lease, that the lease is kept in force by
E pa.yment of 'rental, it being ur~erstood that lessors own on~-half of the ,
~ undivided interest only to the oil and gas rights on the hereinabove described
property. Lessee agrees that it will pa;; delay rentals each year of the
terin of t'r:is le3se unless it furnishes ten days xriiten notice of cancellation
of the lease prior to each anniversary dat~, or until such +_i.me as Les~ee
pays oil ro;~a2ties ? s ~rovided ir paragraph 3 and paragrauh 10.
Lessee a~rees to no13 lessors harmless from all actions or proceedings to re~~z•e: -

of the above described property ~.uider the terms of this lease occasione~ b;~ lessee,
its servants, agents or e:nployees by reason of exploration or other use of the
above cagtionec property ~ur~uant to the +_erms of this lease
~ There is escepted and excluded from this lease and reserved and retained to Lessor, all sedimen-
tary minerals including sand, clay, limestone, dolomitic limestone, chert, flint, marl and phosphate,
above 150 fti in depth, and Lessor re$erves the right of mining, processing, and transporting or mar-
keting these sed~mentary minerale excepted from thi$ lease. Oil, gas, sulphur and salt, wherever
~ situated, are not excepted or excluded from this lease, and no minerals situated at a depth in exceas
~ of 150 ft. from the surface of the land covered by thia lease are excepted therefrom.
~ In the event of damages to the surface of Lesaor'a land, or to Lessor's groves~ trees, fencea,
roads or growing eropa and installations proximately caused by Lessee as a reault of Lessee'a opera-
tione on the land covered by this lease, Lesaee at its option will either pay Lesaor for such damages,
or will, insofar as is reasonably practicable, restore the property to the same condition as it wae be-
fore operatione were begun. ~
The Leesee agrees that, upon the lawful termination of the leaae it will~ upon written requeat, exe-
cute and cauae to be recorded in the Public R.ecorda of St Iucie County,
Florida, an aDprnpri~e_ iliatrument in writing releaaing thie lease. 7~09
