AFFIDAVIT ~
STATE OF WF.ST VIRGINIA,
COUNTY OF KANAWHA, to-wit:
This day personaZly appeared for the undersigned authority,
John A. Hopkins, who being duly sworn, upon oath deposes and says
that he is Vice President and Head of the Trust Department of The
Charleston National Bank of Charleston, West Virginia; that the
records of said Trust Department show that said bank did qualify
and act as Successor Co-Trustee with Charles B. Gates, Jr., under

by deed dated December 15, 1941, of record in the office of the Clerk
of the County Court of St. Lucie County, Florida, in Deed Book 102
at page 289, Clara L. Gates conveyed to C. Bernard Gates, as Trustee
under said Trust Agreement dated December 15, 1941, an undivided one-
~ half interest in that certain tract of land described as:

~ ~The North 500 feet of the East 490 feet of the NW 1/4 of
SE 1/4 of Section 14, Township 34 South, Range 39
East, St. Lucie County, Florida.
That said Trust Agreement was in fact evidenced by two written
instruments containing identical terms and conditions; that under one
instrument Charles B. Gates, Jr., C. Bernard Gates and Mabel Gates
Crickard we-re life tenants and Charles B. Gates, Jr., was remainderman;
that under the other instrument Philip C. Gates, C. Bernard Gates and
Mabel Gates Crickard were life tenants and Philip C. Gates was remainder-

Charleston National Bank; that on December 27, 1951, C. Bernard Gates
died at Charleston, West Virginia; that pursuant to the provision
contained on page 17 of said agreement, providing:
