Hopkins, who being duly sworn, upon oath deposes and says that he is Vice President and Head of the Trust Department of The Charleston National Bank of Charleston, West Virginia; that the records of said Trust Department show that said bank did qualify and act as Successor Co-Trustee with Charles B. Gates conveyed to C. Bernard Gates, as Trustee under said Trust Agreement dated December 15, 1941, an undivided one- ~ half interest in that certain tract of land described as: ~ ~ ~The North 500 feet of the East 490 feet of the NW 1/4 of SE 1/4 of Section 14, Township 34 South, Range 39 East, St. Lucie County, Florida. That said Trust Agreement was in fact evidenced by two written instruments containing identical terms and conditions; that under one instrument Charles B. Gates, Jr., C. Bernard Gates and Mabel Gates Crickard we-re life tenants and Charles B. Gates, Jr., was remainderman; that under the other instrument Philip C. Gates, C. Bernard Gates and Mabel Gates Crickard were life tenants and Philip C.
