Home My WebLink About0687 - 3 - AND WHEREAS the Company and the Trustee have entered into a Fourth Supplemental Indenture made as of the 15th day of April, 1972 (hereinafter called the "Fourth Supplemental Indenture"), pro- viding that Debentures previously redeemed or purchased or re-delivered to the Company may be re-issued; AND WHEREAS the Guarantors have agreed to amend the Guarantee as hereinafter more particularly set forth in order that their guar- antee may extend to the additional principal amount of Debentures to be issued under the Principal Indenture as--amended as aforesaid; AND WHLftEAS the Additional Guarantors have agreed to become parties to the Guarantee and to be bound by all the terms and pro- visions thereof and to secure the same as hereinafter set forth; AND WHEREAS the fbregoing recitals are made as representa- tions and statements of fact of the Guarantors and the Additional Guarantors and not by the Trustee. NOW THEREFORE TIiIS INDENTURE WITNESSETH that in considera- tion of the premises and the sum of one dollar ($1.00) now paid by the Trustee to each of the Guarantors (the receipt whereof is hereby by them respectively acknowledged) the Guarantors covenant and agree ~ - with the Trustee as follows: 1. The Guarantors hereby consent to the increase of their liability under the Guarantee so that the same shall extend to the principal and interest of both the outstanding Debentures and the additional Debentures to be issued under the Principal Indenture as amended by the First Supplemental Indenture and as further amended by the Second Supplemental Indenture and as further amended by Third Supplemental Indenture and as further amended by Fourth Supplemental Indenture. 2. Each of the Guarantors confirms that the mortgage, pledge, and charge contained in the Guarantee shall extend to the aforesaid outstanding Debentures and additional Debentures, and all of the lands, premises, and other property mortgaged and pledged to the Trustee under the terms of the Guarantee, except such portions thereof as have BOOK20~ PACE ~87
