HomeMy WebLinkAbout1006 Should a substantial part or the whole of the premises be so desiroyed or rendered untenantable, Lessee may at its option quit and surrender possession oi said premises hereby lcased, or may, if it shall so desire, upon the completion of the repairs or restoration ot said building, re-occupy the premises upon the terms and oonditions herein set forth. the rent to commence from the date of such re-occu~~tion. 10. In no e~~ent shall I.es.see be liable for destruction or injury by fire to said premises, including the building in its entirnty, its fixtums, ap~urtenances or contents, or any part thereof, which occurs during the term of this I.ease or any extension tt~reui, unic~ the ~nie results directly from willful acts or willfut misconduct on the part of the Lessee, its sen~ants or agents acting in the line and scope of employment; and im m~siderntion of the covenants and conditions contained herein, Lessor for itself, its tenants, successors, subrogcrs and assigns, does hereby release and relie~•e of liability the I.essee for destruMion and injury by fire of the premises, including the building in its entirety, its fixtu:es, appurtenances or contents, or any part thereof, arising out of its occupancy or use of the premises under the terms of this Lease Agreement, including ~reless or negligent acts or omissions of the I.essee, its servants, em- ployees, or aQents, exc~ept where said destruction or injury is caused by the willful acts of the I.essee, its servants or a~ents acting in the line and scope of employment; and the Lessor does hereby aQree to indemnify and save harmless the I.esscr from ~Il loss, injury, or liability on account of any sums of money which I.es.See may be required to pay ! on aceount ef :iny liability or damage by reason of destruction or injury by fire of said premises, building, fixtures, appurtenances or contents which cxrurs during the term of this Lease or any extension thereof. i ll.
