THIS AGREEMENT, made this 8th day of ~°nter~ber , 1g~2,
between FLORIDA POWER ~ LIGHT COMPANY, a Florida corporation, herein-
after referred to as the "Company", and JESSE J. PARKS and CLOTIELD
PARKS, HIS WIFE, hereinafter referred to as the "Grantee",
W I T N E S S E T H:
WHEREAS, the Company is the owner and holder of a parcel of
land lying in and being the South 1/2 of Lot 5, Block 1, Model Land
Company Subdivision in Section 15, Township 36 South, Range 40-East,
as recorded in Plat Book 1, Page 41, of the Public Records of St. Lucie s
County, Florida. . ~
WHEREAS, the Grantee desires the Company's consent to use for {
access road purposes the East 40 feet of the South 1/2 of Lot 5,

Block 1 as described above. i

NOW, THEREFORE, the parties hereto do agree as follows:
1. The Grantee shall hold the Company harmless from and against ~

. ,
claims and damages to property or injury to persons whether or not =
due to or caused by the negligence of the Company that may be resulted ;
from or attributable to the Grantee's use of this property.

~ 2. The Grantee shall not permit or use any vehicles or equipment
~ ~
i capable of extending in excess of 18 feet above grade. ;

~ 3. The Grantee will not use the property in any manner that
~ would interfere with the construction, operation or maintenance of
~ ;
the Company's facilities. The Grantee's use of this property shall ~
always be subordinate to the Company's interests and the right to
use its property for the construction, operation and maintenance of
- its electric transmission line facilities. ~ ;

~ 4. The Grantee is aware that the electric transmission lines ~
~ i
~ to be installed by the Company will be conductors of high voltage
~ '
~ electricity and that the Grantee will exercise extra-ordinary pre- i
~
cautions so as to prevent damage to property or injury to persons
in the vicinity of such lines, and Grantee agrees to notify their
employees, agents, contractors, invitees and licensees of the j
:
existence of said high voltage lines when so installed.
