assessments, fees and go~ernmental and non-governmental charges levied,
. iinposed or assessed upon or against Alortgagor or any of its properties;
~g'~ IMPROVEMENTS: All improvements and replacemenis thereof
now constructed or hereafter to be constructed under, on or above the
Land, including, but not limited to, 320 mobile and modular home
lots and a par-three golf course comprising Phase III;
also, 490 lots to comprise Phase IV,
which term includes any part of the Improvements;
~Il~ INDEBTEDNESS: T~le PilIlClPa1 Of, interest on and/or all other
amounts, payments and premiums due under the Note and all other
indebtedness of 14iortgagor to 14tortgagee under and/or secured by the
Security Documents and/or otherwise;
~1~ LAND: The real estate (and other interest or interests in real
estate, if any ) described in F.~chibit A attached hereto which by this ref-
erence is made a part hereof for all purposes, which term includes any
part of the Land;
~ j~ LEASES : Any and all leases, subleases, licenses, concessions or
grants of other possessory interests grar_ted by Mortgagor as lessor, now or
hereafter in force, oral or ~vritten, covering or affecting the Mortgaged
Property;
(k) Lo~N AGREErYENT: T~le Loan Agreement, dated of even date
herewith, between b'Iortgagor and Construction Lender, which by this
reference is incorporated herein foz all purposes;
(1) MaruRirY DnTE: The Maturity Date as stated in the Note;
~lri~ MORTGAGED PROPERTY: The Land, the Improvements and the
Fixtures (and Personal Property, if any), together a•ith:
(i) all rights, privileges, tenements, hereditaments, rights-of-
way, easements, appendages, appurtenances, riparian or littoral rights
belonging or in anywise appertaining to the Land and/or the Im-
