Any real estate or any interest or estate therein sold pursuant to any court order obtained by virtue of this riortgage or the other Security Documents, or pursuant to any other judicial proceedings under this 11lortgage or the other Security Documents, or pursuant to any right of I~Iortgagee to sell the hlortgaged Property, may be sold in one parcel, as an entirety, or in such parcels, and in such manner or order as Aiortgagee, in its sole discretion, may elect, to the maximum extent per- mitted by the laws of the state in which the r-tortgaged Property is situated. 7.3 REMEDIES CUTiULATIVE A:`D CONCURREIVT. The rights and remedies of A~Iortgagee as provided in the Note, in the Security Documents and in the guaranty of any Guarantor shall be cumulative and concurrent ~ and may be pursued separately, successively or together against 1~Iprt- r gagor, any Gu:irantor or the 1lfortgaged Property, or any one or more of E ~ them, at the sole discretion of 1lortgagee, and may be exercised as often E as occasion therefor shall arise, all to the maximum extent permitted ~ by the la~cs of the state in which the i~Iortgaged 1'ropcrty is situated. ~ If ~Iortgagee elects to proceed under one right or remedy under the Security ~ Documeiits or the Note, Alortgagee may at any time cease proceeding ~ under such right or remedy and proceed under any oth~r right or remedy ~ _ under the Sc~curity Documents or the Note. The failure to e~cercise any ~ such rigl;t or remedy shall in no event Ue construed as a«aiver or release ~ thereof. Nothing in the Note or the Security Documents shall affect ~Iort- gagor's obtigations to pay the Indebtedness and perform the Obligations in ~ accordance ~vith the terms thereof. ~ 7.4 CxEVir oF i~IoRTC,~cEE.
