TEMPORARY DRAINAGE EASEMENT

between HALLMARK CONSTRUCTION COMPANY OF FLORIDA, of the County
of Orange and State of _Florida, GRANTOR, anc~ _th_e_ CITY_ OF FORT
PIERCE, of the County of St. Lucie and State of Florida, GRANTEE.
WITNESSETH, that the Grantor, in consideration of the sum
of $10.00 and other valuable considerations paid by the Grantee,
the receipt whereof is hereby acknowledged, does hereby give and
grant to the Grantee and its assigns a right-of-way and easement
for drainage purposes, with full authority to enter upon, construct
and maintain, as the Grantee and its assigns may deem necessary,
a drainage ditch, pipe or facility over, under and upon the following
described lands situate in St. Lucie County, to-wit:
An easement 60 feet in width lying 30 feet either
, side of the following described line:
Commence at the NW corner of the NE~, of the SW;
of the NE~. of Section 17, Township 35 South, Range
40 East; thence North 00°00'00" East 170.29 feet;
the~ce North 90000'00" East 11.84 feet to the
Point of Beginning of said centerline; thence
continue North 90°00'00" East 285 feet; thence
North 35°14'39" East 579.22 feet; thence North
00°00'00" West parallel and 30.00 feet West of
the East line of the NW4 of the NE; of said
Section 17 a distance of 638.73 feet to the South
line of the N.S.L.R.D.L~. Canal No. 5, said point
! being the termination of this easement.

TO HAVE AND TO HOLD said right-of-way and easement unto said
~ Grantee and its assigns for'such time as same shall be used for
~ the purposes herein set forth or until such time as the Plat of
~ PINECREST ESTATES, UNIT NO. TWO shall be properly filed of record
~ in the Office of the Clerk of the Circuit Court of St. Lucie County,
# Florida.

~ Reserving, however, to the Grantor the right and privilege
Y of using said property for any purpose which does not interfere
~ with the use of the same by the Grantee for said drainage purposes,
~ but the Grantor shall not construct any buildings or other facili-
~ ties on the herein granted right-of-way that may interfere with
~ the normal operation or maintenance of the drainage ditch, pipe ~o~

~ At such time as a Subdivision Plat of PINECREST ESTATES,
~ UNIT NO. TWO shall be filed of record in the Office of the Clerk
~r~ of the Circuit Court of St. Lucie County, Florida covering the
- property upon which this easement is granted then-~iis easement
- shall automatically terminate and all right, title and interest
to the Grantee in and to, and by virtue of this easement, shall
- automatically revert to the Grantor, his successors and assigns,
- and this easement shall become null ann void and of no further
~2' effect.
