Except for the aforesaid First Mortgage, NORTH TRAIL covenants that the Premises are free and clear of all mortgages, liens, encumbrances and judgments and of any and all claims of lien; that there are no legal proceedings pending which could result in the Premises being subjected to a iien, encumbrances or claim of interest adverse to NORT1~ TRAIL; that there are no delinquent taxes of any kind which constitute or may constitute a lien aqainst the Premises. 3. iJORTH TRAIL agrees for the period of the aforesaid option, that is for two ~years from tne date tzereof , not to mortgage, encum.i~er, create or permit a lien to be claimed or filed against the Premises. 4. This agreement shall be binding upon the parties hereto and their respective successors and assigns.
