In the event any dispute arises under the provisions of this para-
graph 4 hereunder, such dispute shall be settled by arbitration as pro-
vided by the provisions of paragraph 9 hereunder.
5. The water level in the unitary canal system and Canal No. 3,
as aforesaid, shall be maintained at a level which will best be suited
to accomplish the primary objective of said cana2 system, more particu-
larly set forth in Paragraph 2, above, unless otherwise agreed by the
parties in writinq. To this end, both parties shall be deemed to have
possession of and be entitled to use and operate all canals, channels,
levees, sluice gates, pumps and pumping stations and all equipment appur-
tenant and essential to the operation thereof for discharging excess
surface waters into said unitary canal system and (from Parcels A and B)
into Canal No. 3 or elsewhere, as the case might be.
6. The aForesaid agreements with.Lakewood Park Property Owners'
Association, Inc., and Fort Pierce Farms Drainage District shall be deemed
to be for the mutual benefit of both parties hereto and North Trail here-
by assigns and sets over unto Trafalgar Developers an undivided interest
in said agreements and agrees to notify the aforesaid parties of such
assignment. All of the terms and conditions of said agreement shall be
deemed to be incorporated herein by reference and subject to the terms of

this Joint Use and Easement Agreement.
7. ?ahen either party desires to give notice to the other in

; connection with or according to the terms hereof, such notice shall be

~ given ?=y certified mail, return receipt requested, and shall be deemed

given when deposited in the United States Mail with sufficient postage
; prepaid thereon to carry it to its addressed destination, as follows:
