257.28 Feet to the Point of Beqinning,
to have and to hold the easements hereby granted unto North Trail, its
successors and assigns as appurtenant to Parcel A of North Trail. It
is understood that this easement is given upon the express understanding
and condition that it may be used by Trafalgar Developers, its successors
and assigns in conjunction with the use of North Trail. ~
3. Each party shall have the right to enter upon the ease-
ment hereby granted to it and grade, level, fill drain, pave, build,
maintain, landscape, repair, rebuild a private road or pathway together
with such culverts, ramps and cuts as may be necessary on, over and across
the area embraced within the rights of ~~ay of the respective parties
hereinabove aescribed.
4. Neither North Trail nor Trafalgar Developers their successors
and assigns assume any responsibility or liability to the other or any
person using the easements, hereby granted, by invitation, expressed or
implied, or by reason or any business by either party hereto, their
successors and assigns.
5. These easements shall constitute covenants running with the
land. In the event Trafalgar Developers exercises its option to purchase
' Parcel A from North Trail within two (2) years from the date hereof, these
! easements shall terminate and be of no further force or effect and the

~ parties shall execute and record a cancellation of easement agreement;
