waters situate on the property described above for the purpose .
of preserving to the grantor, its successors in interest and
assigns, free access over said channel and its waters and ingress
to and egress from said channel to the Indian River and the
Intracoastal Waterway. The channel referred to herein is the
same channel described in that certain Channel Easement Agreement ~
executed on this date between grantor and grantee.
The conveyance of the above described land is f~rti?~Ar
subject to easements, restrictions, reservations and rights-of-
way of record and taxes accruing subsequent to December 31, 1971,
and any right, title or interest of the State of Florida to
include the Trustees of the Internal Improvement Fund.
TOGETHER with all tenements, hereditaments, and
appurtenances thereto belonging or in anywise appertaining.
Z'0 HAVE AND TO HOLD the same in fee simple forever.
AND the grantor hereby covenants with said grantee that
it is lawfully seized of said land in fee simple; that it has
good right and lawful authority to sell and convey said land,
that it hereby fully warrants the title to said land and will
defend the same against the lawful claims of all persons whomso-
ever; and that said land is free of all encumbrances, except
taxes accruing subsequent to December 31, 1971.
This conveyance is subject to the following restric-

tions, conditions, covenants and reservations which are
specifically imposed on the land conveyed above.

1. The real property conveyed herein shall be used ;

exclusively for marine research,-scientific and educational pur- !
poses. Grantee shall not use the prvperty for a commercial
shipyard provided always that grantee may use the property fnr
repair, renovation, alteration or maintenance of vessels, vehicles,
or equipment used in or related to the operation of its m~:_rine
research, scientific and educational activities.
