14 . Waiver of Defenses . In the event of any assignment hereof
by I~4ortgagee, i~iortgagor covenants and agrees that :~4ortgagor will not
assert against any assignee hereof any claim or defense which hiortgagor
may have against ~t~iortgagee, except i'.4ortgagor may assert agafnst any
such assignee any defense oE a type which may be asserted againsi a

holder in due course of negotiable instruments under the Uniform Commercial '

Code.

15. il~ortgage Also a Security Agreement. This Mortgage shall '
also be construed as a security agreement under ihe Uniform Commercial
Code.
16 . Gender and Number . The term ;~Iortgagor shall be construed
as singular or plural, masculfne or feminfne, and corporate, partnership
or individual, whichever the context hereof requires or admits.
17. Rights with Regard to the Collateral. ~Iortgagee with
regard to the Collateral sha11 have and may exercise from time to time any ~

and all rights and remedfes of a secured party under the Uniform Conuncr - '

cial Code of the State of Georgia , and any and all other rights and ~

rer.ledies available to it under any other applicable law, including the
right to foreclose this : lortgage and upon request or demand of ~iortgagee,
;~.4ortgagor shall, at the expense of '~fartgagor, assemble the Collateral and
make it avai2able to the ?.4ortgagee at a reasonably convenient place
designated by :tiiortgagee .
