the number of acres the Seller represents are contained in the subject
property, namely 1, 200 plus or minus. The Buyer shall cause a certified
survey of subject real property to be prepared at Seller's cost and
expense, ~vhich survey shall be certified unto Buyer and said survey shall
further certify the net acreage herein conveyed, covered by the legal
description. Said survey shall further sho~i~ that the real property herein
conveyed is contiguous and no hiatus exists as to the land herein conveyed.
It is agreed, however, that the purchase price shall not be less than
Five Hundred Thousand One Dollar ($500, 001. 00) .
2. TERMS OF SALE:
The Seller ackno~vledges the payment of the sum of TEN
THOL'SAND DOLLARS ($10, 000. 00) paid simultaneously herewith as a
; deposit toward the purchase price. The balance of the purchase price

~ shall be payable to Seller in cash and/or cashier's check at closing in

; the sum of FOLjR HLTNDRED NINETY THOUSAND FOUR HtJNDRED

~ EIGHTY DOLLARS ($490, 480. 00). The balance of the purchase price

~ shall be plus or minus the net acreage in fee; as determined by the

~ certified survey, intending that the final purchase price shall be based
~ upon the net acreage in fee conveyed from Seller to Buyer but in no event

~ less than Four Hundred Ninety Thousand One Dollar (~490, 0~1. 00>.

~ 3. ABSTRACT OF TITLE:

~ As soon as possible from the date of execution of this
Agreement bet«~een the Buyer and Seller, the Buyer shall cause to be prepared,
at Seller's expense, an abstract of title brought current to a date subsequent
~ to the execution of this Agreement showing Seller's title to be good, market- j
y able and insurable, and further showing no liens, encumbrances, restricti~ns,
