DONALD S. KATES, of full age, upon his oath, deposes
and says:
1. He is an attorney-at-law licensed to practice ~
law in the State of New Jersey with offices at 47 Orient

2. He is one of the Trustees named in the attached
copy of Indenture of Trust, the copy of which is a true and
accurate copy of the original trust instrument, and which is
the same trust instrument referred to in a certain Warranty
Deed dated August 20, 1958 and recorded September 15, 1958, ~

in Deed Book 240 at page 558 of the public records of St.
Lucie County, Florida, and also the same instrument as is
referred to in a certain Warranty Deed dated January 29,
19G5 and recorded March 31, 1965 in Official Record Book 114
at paQe 392 of the vublic records of St. Lucie County, Florida.
j 3. Simon H. Strickler, one of the Trustees named in
€ said Trust Indenture, is dead. The sole surviving and acting }

~ Trustees, Edward H. Meier and the deponent, have not appointed

~ a successor trustee. ;

~ 4. Diana B. Pedevill, named a beneficiary in said

~ Trust Ir~enture, is dead. The remaining beneficiaries,
Robert Pedevill and Anne P. Kates, have not transferred
~ their interest in the Trust.
