HomeMy WebLinkAbout1739 tiOW, THERE~ORE, in ~an~id~ration of the nutual covenants and considerations accrued to the parties hereto, it is agreed as . follows: 1. The first Party does hereby modify the terms of pay- ment of the principal balance of said note so that the same shall be payable in monthly installments of Two Hundred Fifty Dollars ($250.00) each, the first of said payments to be made on the 15th day of January, 1973, and a like sum of Zwo Hundred Fifty Dollars ($250.00) on the 15th day of each month thereafter, until the said note or any balance thereof shall be paid in full. 2. The Second Parties hereby assign to the First Party all payments due the Second Parties on the Agreements for Deed listed in Schedule 1 attached hereto which accrue after the date or this mortgage modification agreemznt to the extent of thz unpaid principal balance together with interest at the rate of six percent ' (6%) per annum on the mortgage hereby m~dified, however this assign- i ~ ment is conditioned so that provided the Second Parties make the f ~ payments on the mortgage as herein modified promptly, then the a sa 2 Second Parties shalZ continue to collect the periodic payments on the Agreements for Deed as set out in Schedule 1 attached hereto. ~ ~ 3. The assignment by the Second Parties to the First Party shall become unconditional at any time when the $250.00 mort- gage payment due from the Second Parties to the First Party as ~ modified herein is in default more than fourteen (14) days; and the ~ ~ Second Parties do thereupon grant to the First Party the right to ~ _ enter the premises of the Second Parties now located at 436 A North `w~ Seventh Street, Ft.
