If a defPnse shall be brouqht by the Lessee and timely pros~cuted and the Lessee shall comply with the above provision with regard to notice ~~~~d information to the Less~r, then the right of the Lessor to terminate by reas~n of the provisions of this section shall be controlted by the outcome of such litig~tion, to-wit: u. If such litigation be resolved in favor af th~ .L4ssor sha3l have no right to terminate by reason of the occurance of the 3cts above listed. b. If such litigation be resolved ay~~~st the Lessee, - the Le~sor shall have the right to terminate as above pfiovided, but ~othing herein shall be construed as re- iiev~ny the Lessee of the performance of_any of its cov- enants herein which became performable prior to the det- ermination of the outcome of such litigation or the earlier abandonment of defense by the Lessee. 28. Entire Agreement. This instrument constitutes the entire agreement between the parties, and neither party has been induced by the other by represeniations, promises or understand- ings not expressec~ herein, and there are no collater~l agree- ments, stipulatiuns, promises or understandings whatsoever in am~ way touchiny the subject matter of ±his Agreement which are . not exp;essly ~ontained herein. 29. Notice. Wh~neverT ~nCer the terms of this Leas~ Agree- ment, reference is made to the giving of notice h~ one of the parties hereto to the other, or whenever either of the parties shall desire to give notice of any matter to the o~her, such notice shall be given and shall be deemed suffic~ent when given by vrritten instrumer.t sent by registered or certified r~ail, return receipt reguested, addressed to thP appropriate party, with postage prepa~d. Captions and Titles.
