Commori Elements shall include: (a) all of the condominium property excepting only the apartments t:~emselves; (b) the tangible personal property required for the maintenance and operati~n of the common elements even though owned by the Association; and (c) other items as stated in the Condominium Act. - 2.5. Common Expenses include: (a) expenses of ad- ministration, and expenses of maintenance, operation, repair or replacement of the common elements and of the portions of the apartments to be maintained by the Association; (b) expenses declared corximon expenses by grovisions of this Declaration or the Bylaws; and (c) any valid charge against the condominium property as a v~ hole. 2. 6. Condominium means all of the condominium pro- perty as a~vhole when the context so permits, as ~vell as the meaning stated in the Condominium Act. ~ 2. Conduminium property means all of the land as described in Paragraph I hereof and shown on the survey, a copy of which is attached hereto and made a gart hereof as Exhibit "D". 2. 8. Singular, Plural, Genc~er: VVher ~ver the cantext so permits, the use of the plural shall include the singular, the singular the plural, and the use of any gender shall be deemed to include all genders. 2. 9. Utility Services: As used in the Condominium Act and as construed zvith reference to this condominium, and as used in - the Declaration and Bylaws, shall include but nat be limited to electric po~v- ~ er, hot and cold water, drainage, heating and refrigeration, airconditioning, E and garbage and sewage disposal. f i 2. 10. Reasonable Attorney's Fees means and includes ~ reasonable fees for the services of attorneys at law ~vhether or not judicial or ~ administrative proceedings are involved, and, if judicial or administrative ~ proceedings are involved, then all review of the same by appeal or otherwise. ~ 2. 11. 2~lember means an apartment o~vner who or which is a member of BEACH CLUB COLONY COND01~lINIli1r] ASSOCIATION, INC. , ~ a Florida not for profit corporation. Such membership al~o includes member- ~ ship in BEACH CLUB COLONY ON THE OCEAN, INC. , a corporation not for profit organized and existing under the laws of the State of Florida. ~ III.
