Each apartment st~all in- cli~le that part of the bui;ding ~ ontaining the apartn~e:~t that lies within the Uoundaries of the apartment, ~vhich boundaries are as follows: (a) Upper and L,ower Boundaries. The upper and lower Uoundaries of the apartment 5ha11 be the following Uoundaries extended to an intersection ~~~ith the perimetrical Ueundaries: - (1) Upper boundary - the horizontal plan~ of the undecoi•ated finished~ ceiling; and (2) Lower boundary - the hori~onta! plane of the undecorated finished floor. (b) Perimetrical Boundaries. The perimetrical boundaries of the apartment shall be the vertical planes of the undecorated fin- isheci interior of the ~valls bounding the apartment extended to ir_tersections with each other and with the upper and lower boundaries; provided, however, that when there is att~ ched to the building a balcony, terrace, canop,y, or other portion of the building serving only the apartment being bounded, such boundaries shall be the intersecting vertical planes adjacent to and ~vhich in- clude all of such structures an~ fixtures thereon. - 3. Common Elements. The common elements include all the items described in Paragraph 2. above and include but are not limited to the following items as to which the Association shall have th~ powers indicated. (a) Automobile Parking Areas. Automobile park- ing ~vill be made available to apartment owners so that the occupan±s of each apartment will be entitled to parking for one automobile ~vithout charge. The Association shall ha~e authority to make reasonable charges for the parking of automobiles in excess of one for each apartment. Parking areas will not be assigned but will 3e available pursuant to the regulations of the Association. (b) Utility Area. Th~ utility area shall be avail- ~ able for use by all apartment oK ners ~vithout charge ex~ept Evheci specifically ~ authorized by the regulations of the Association. ~ (c) L'se; Charges. The foregoing and all other ~ common elements shall be available for use by ali apartment o~vners ~c~ithout ~ discrimination. Such use will be v~~ithout chai•ge except ~vhen specifically au- ~ thorized by the regulations of the Association. ~ I ~ 1V. THE APARTi1tENTS: ~ ~ 1. The Apartments. There are ten (10? apartments in the condominium, laid out in substantial conformity to the plans and speci- ~ fications a portion of ~vhich are attached hereto as 14',xhibit "E". 4.2. Apartment Numbers. There are five (5) apart- ments upon the first floor of thF building, numbered consecutively'beginning e ~vith Apartment 101 on ihe Southerly ena of the building and ending with Apart- ~ ment 105 on the IVortherly end cf the building. There are five (5) apartments q upon the second floor of the building, numbered consecutively beginning with ` Apartment 201 on the Southerly end of the 'auilding and ending ~vith Apartment 205 ~ on the Northerly end of the building. ~ 4. 3. A purtenances To A artments.
