"s. Use. Each dock shall he used by~ its owner solely and exclusively in connection with the use and enjoyment of the owner's apart- ment, and not for ~om2nercial purposes or other~vise, provided, ho~vever, that the Developer shall not be subject to any such restriction. ~ 5.4. Association Liability. The Association shall not be . responsible for, and the dock owner shall indemnify and hold harmless the Asso- ciation from, any and all damages, injuries, claims, suits, causes of action, and judgments arising out of oi• in anywise attributabZe to #he use of said dock b3• the owner thereof, his family, guests, invitees and licensees. 5. 5. Common Elements. The common elements include an undivided one-s~th (1/6) interest in the Condominium Boat Dock Area des- cribed above, with the exception of the boat docks themselves and their support- ing structure. VI. 1~%IAINTENANCE, A LTER.ATION AND Ii4IPROVEl~~IENTS: - Respcnsibility for the maintenance of the condominium property, and restrictions upon the alteration and improvement thereof, shall be as follows : 6, 1. Apartments. (a) By the Association: The Association shall maintain, repair and replace at the Association's expe~e: i (1) All portions of an apartment, except ~ interior surfaces, contributing to the support of the apartment building, which E portions ~hall include but not be limited to the outside walls of the apartment ~ building and all fixtures on its exterior, boun~ary walls of apartments, floor and ceiling slabs, loa~~-bearing columns and load-bearing walls; ~ E (2) All conduits, ducts, plumbing, wiring and other facilities for the furnishing of utility ~ ervices contained in the portions af an apartment maintained by the Association; and all such facilities contained within an apartment that service part or parts of the condominium other than the apartment within ~~hich contained; and ~ (3) All incidental damage caused to an apartment by such ~vork shall be repaired promptly at the expense of the Asso- ciation. 4 (b) B~ the Apartment Owner: The responsi- 5 bility of the apartment owner shall be as follows : ~ ~ • (1) To maintain, repair and replace at ` ~ his expense all portions of his apartment except the portions to be maintained, a : epaii•ed and replaced by the Association.
