AGREEMENT MODIFYING MORTGAGE
WHEREAS, S. P. VAN I.F~NDINGHAM and ERNESTINE VAN LANDINGHAM,
his wife, dict on January 12, 1973, make, execute and deliver a
certain mortgage deed to FIRST FEDERAI, SAVINGS AND LOAN ASSOCIATION
OF FORT PEIRCE, a corporation organized and existing under the laws
of the Gnited States of America, which mortgage was recorded in O. R.
Book 210 at page 470 of the public records of St. Lucie County, Florida,
a.nd which mortgage deed encumbered certain real property in St. Lucie :
County, Florida, descri.i~ed as follo~s : ;
From a point on the West ~ine of the Northeast 1/4 of the
Southwest 1/4 of Section 8, Township 35 South, Range 40 East, ;
225 feet 5outh of the Northwest corner thereof (which is~in
the centerline of State Road 68); run thence East, parallel
with the centerline of Stat~ Road 68 (Orange Avenue), a
distance of 160 feet for Point of Beginning; thence continue
East, para21e1 with the centerline of said State Road 68, a
distance of 240 feet, ther~ce run South, parallel with the
West line of said Northeast 1/4 of South•~est 1/4, a distance
of 192 feet; thence run West, parallel with course number one,
240 feet; thence run North 192 feet, more or less, to Point
of Beginning; ~
Al1 being in the Northwest 1/4 of the Northeast 1/4 of the ;
Southwest I/4, Sectian 8, Tc~wnship 35 South, Range 40 East. ?
as security for an original principal debt of $23,104.00 evidenced ;
by a promissory note, a copy of which was set out in said mortgage ~
deed; and ;
WHEREAS, the description of the property as set forth in said
mortgage is in error and the mortgagor and mortgagee have mutually ~
agreed that said mortgage shall be modified and amended so as to
correct the erroneous description;
NOW, THEREFURE, in consideration of the foregoing and other ;
good and valuable considerations and the mutual covenants anci
promises herein made and the sum of One Dollar ($1.00) each to the
other paid, S. P. VAN LANDINGHAM and ERNESTINE VAN LANDINGHAM, ~
his wife. hereinafter called the Mortgagor and FIRST F~DERAL SAVINGS
AND LOAN ASSOCIATION OF FORT PIERCEs hereinafter called the Mortgagee,
agree as follows:
That the mortgage dated ~Tanuary 12, 1973 and recorded in j
O. R. Book 210 at page 470 of the pub~.ic records of St. Lucie Cdunty, `
Florida, shall be modified, amended and corrected so that the t
description of the property encumbered by said mortgage shall be
as follows :
From a point on the West line of the E 2/2 of the NE 1/4
of.the NW 1/4 of the SW 1/4 of Section 8, Township 35 South,
Range 40 East which is 225 feet South of the NW corner thereof
(which is in the.centerline of State Road No. 68), run thence ~
East (Para11Q1 with the centerline of State Road No. 68) 160
feet to a point in the East line of right of way conveyed
to St. Lucie County in O. R. Book 28, page 183 for Point of
Beginning; from thence continue Ea~t 24p feet to point in t5e
West line of right of way conveyed to St. Lucie County ~n
O. R. Book 28, page 185; thence Scuth along said West right
of way line I92 feet to a point in the North line of
