MORTGAGE MUDIFI CATIO.V AGREEMENT
V~''-iE~:EAS, JULLAN WALKER and GR.ACE WA LKL•'K. his wife, did on
January 3, 1973, malce. execute and deiiver a certain mortgage deed to r'irst
Feneral Savings & L~an Association of Fort Pierce, Florida, a corporation organized
and eKisting under the laws of the United States of A me rica, which mortgage was
recorded in OR Book 209, page 2289, of the public records of St. Lucie County, Fla. ,
and which mortgage deed encumbereci certain real property in St. Lacie County. Fla. ,
described as follows:
Lots 1 and 4, of CLYDESDA LE HEIGHTS SUBDIVISION, as per
plat thereof on file in Plat i3ook 9, page 59, of the Public Records
of St. Lucie County, Florida,
Said mortgage being inferior only to a prior first mort gage from
mortgagor to mortgagee, recorded OR Book 202, page ?00 of
the public records of St. Lucie County, Fla. ,
as security for an original principal debt of Two Thousand Eight Hundred Thirty-
Three Dollars and Eighty Cents ($2, 833. 80) evidenced by a promissory note, which
promissor~r note was set out in said mortgage deed; and
WHER'iAS, the description of the~property set forth in said mortgage
is in error and the mortgagor and mortgagee have mutually agreed that said mortgage
shall be modified and amended so as to correct the error in said description;
1~OW, THEREFORE, iri consideration of the foregoing and other good
and valuable considerations snd the mutual covenants and promises herein made ~
and the sum of One ($1. 00) Dollar each to the other paid, JULIAN WALKER and GRACE
WALKER, his wife, hereinafter called the Mortgagor and First Federal Savings &
Loan Association of Fort Pierce, Florida, hereinafter callecl the Mortgagee, agree
as follows:
1. That the mortgage deed dated January 3, 1973, and recorded in
; OR Book 20~, page 2289 of the public records of St. Lucie County, Florida, shall
be modified, amended and corrected so that the description of the property encumbered
by said mort~age shall be as follows:
Lots 1 and 4, Block 1, of CLYDESDALE HEIGHTS SUBDIVISION, as
~ per plat thereof on file in Plat Book 9, Page 59, of the Public Records
of St. Lucie County, Fla.
2. That the above description as set forth in paragraph 1 above is hereby
and hei•ewith made a part of said mortgage as though it had been originally
described and incorporated therein.
~ 3, i nat tl~is agreement shall not be deemed to modify or amend said
~ mortgage e~cept as specifically set forth herein, and the mortgagor hereby
~ ratifies and confirms the said mortgage as modified and amended.
