(hereinafter referred to as the "Developer") and ECOLOGICAL UTILITIES, ~
INC. (hereinafter called "Service Company").

W I T N E S S E T H: ~

W~REAS, the Service Company owns and operates in Hutchinson ~ i
Island a central w•ater system, and provides water di$tribution ;
facilities to proper~ies and the occupants thereof in Hutchinson ;
Island; and ~

WSEREA?, the Developer is the owner of the property described ~
in Exhibit "A" attached hereto (hereinafter referred,to as the ~
'Property"), and the Developer is desirous of connectinq to the ;
central water system so that there will be availabl~ to the Prop- '
erty and the i~.~rovements to be constructed thereon from time to ~ r
ti.uae and t:~e occupants thereof, adequate water supply from the a i~
central water syszem of the Service Company in order to meet the !
requirements of certain Federa],State and private agencies; and ~

WHEREAS, the Utility is willing to provide Developer's !
Property with water service in accordance with the:terms of this =

NOW, T~R~FORE, in consideration of the premises and of the ~
mutual covenan~s and agreements herein contained, the parties •i
~ hereby agree as follows: ~

1. Developer hereby gives and grants unto Service Company,
its successors and assigns, the exclusive perpetual right and 'c

privilege to own, raaintain and operate the water system to s erve :
the propert~; an3, the exclusive and perpetual rignt, privilege, - ~
ease: ien~ ana rig::t-of-way to construct, reconstruct, install, _ ;
lay, own, operate, naintain, repair, replace, renew, improve, :
alter, extend, ~e::.~ve, relocate and inspect water transmission n
and distri~ution liZ~s, mains, pipes,- laterals, valves, conn-
ections and ali related and appurtenant facilities and equipment
in, under, througn, over, uoon and across all present and future _
streets, avenues, roads, terraces, places, courts, alleys, ways,
easer.~eats, reserved utility strips and utility sites, rights-of-
way and easer.ients, and otner public, quasi-public and reserved
ways, areas, p?aces 3nd locations, including but not limited to
~ any lake, car.ai or otner water area, shown on any plat or plats
~ of tne property, ar any part thereof, which may be recorded from
time to ti:..e, or •~.zicn may be provided for in agreements inde~endent
of sucY~ p~at or ~ia~s, or in dedications or otherwise (all of the
