(hereinafter referred to as the "Developer") and ECOLOGICAL UTILITIES, ~ INC. (hereinafter called "Service Company"). 1 , W I T N E S S E T H: ~ ~ i W~REAS, the Service Company owns and operates in Hutchinson ~ i Island a central w•ater system, and provides water di$tribution ; facilities to proper~ies and the occupants thereof in Hutchinson ; Island; and ~ i. , WSEREA?, the Developer is the owner of the property described ~ in Exhibit "A" attached hereto (hereinafter referred,to as the ~ 'Property"), and the Developer is desirous of connectinq to the ; central water system so that there will be availabl~ to the Prop- ' erty and the i~.~rovements to be constructed thereon from time to ~ r ti.uae and t:~e occupants thereof, adequate water supply from the a i~ central water syszem of the Service Company in order to meet the ! requirements of certain Federa],State and private agencies; and ~ c WHEREAS, the Utility is willing to provide Developer's ! Property with water service in accordance with the:terms of this = i ~ Agree~ent; - - ! ~ NOW, T~R~FORE, in consideration of the premises and of the ~ mutual covenan~s and agreements herein contained, the parties •i ~ hereby agree as follows: ~ i ~ ~ 1.
