HomeMy WebLinkAbout2105 ' ~ ;~;s34~~ ' MORTGAGE MODIFICATION AGREEMENT WHEREAS, JOSEPH E. MROZ and ROSE G. MROZ, his wife, did on November 28, 1972, make, execute and deliver a certain mortgage deed to BOCCANEER BUILDING CORPORATION, a Florida corporation, which mortgage was recorded in O. R. Book 209. at page 2696 of ~ the public records of St. Lucie County, Florida, and which mortgage deed encumbered certain real property in St. Lucie _ County, Florida, described as follows: The South 24.4 feet of Lot 5, and the North 38.6 i feet of Lot 7, Block 3, SUNRISE TERRACE SUBDIVISION, as per plat thereof on file in Plat Book 5, page 55, of the public records o£ St. Lucie County, Florida as security for an original principal debt of $2,000.00 evidenced by a promissory note, which promissory note was set out in said mortgage ~ deed; and . WHEREAS, the description of the property set forth in said mortgage is in error and the mortgagor and mortgagee have mutually agreed that said mortgage shall be modified and amended so as to correct the error in description; - NOW, THEREFORE, in consideration of the foregoing and other good and valuable considerations and the mutual covenants and promises herein made and the sum of One Dollar ($1.00) each to the other paid, JOSEPH E. MROZ and ROSE G. MROZ, his wife, hereinafter called the~Mortgagor, ~nd BUCCANEER BUILDING ~ CORPORATION, a Florida corporation, hereinafter called the ' Mortgagee, agree as follows: 1. That the mortgage deed dated November 28, 1972 and recorded in O. R. Book 209 at page 2b96 of the public records of St. Lucie County, Florida, sha11 be modified, amended and corrected so that the description of the property encumbered by said mortgage shall be as £ollows: The South 12.2 feet of Lot 7 and all of Lot 9, Block 3, SUNRISE TERRACE, a subdivision as per plat thereof on file in Plat Book 5, page 55, of the public records of St. Lucie County, Florida. 2. That the above description as set forth in Paragraph 1 above is hereby and herewith made a part of said mortgage as though it had been originally described and incorporated therein. ~ 3. That this agreement shall not be deemed to modify or ? amend said mortgage except as specifically set forth herein, and ; the mortgagor hereby ratifies and confirms the.said mortgage as modified and amended.
